Terms of Use

1. Who we are

ThumbnailUp (“the Service”, “we”, “us”) is operated by Trebuh, a private individual based in Poland. You can reach us at trebuhdev@gmail.com for all matters related to these Terms, takedown notices, or general enquiries.

2. What ThumbnailUp does

ThumbnailUp is a research and discovery tool that helps creators study publicly available YouTube thumbnails. It indexes metadata about videos (titles, channel names, view counts, publish dates, automatic tags) and links to thumbnail images served directly by YouTube. We do not store thumbnail image files on our servers — your browser loads them straight from YouTube.

The Service is intended for informational and educational use. It is not affiliated with, endorsed by, or sponsored by YouTube, Google, MrBeast, or any creator whose thumbnails appear in the index.

3. Eligibility and account

You must be at least 16 years old to use the Service. The current version is browseable without an account. If we add accounts in a future version, additional terms specific to accounts will apply at that time.

4. Acceptable use

You agree that you will not:

  • Scrape, crawl, mass-download, or otherwise programmatically extract data from the Service beyond ordinary browser use;
  • Resell, sublicense, or redistribute thumbnail images, channel data, or aggregated metadata obtained through the Service;
  • Use the Service to harass creators, infringe their rights, or falsely imply endorsement by any creator;
  • Attempt to circumvent rate limits, authentication, payment, or any technical access controls;
  • Use the Service in a way that violates the YouTube Terms of Service or any applicable law.

We may suspend or terminate access to the Service at any time, with or without notice, if you breach these Terms or use the Service in a way that creates legal or operational risk.

5. Third-party content (thumbnails and channel data)

Thumbnail images and channel information shown on the Service are the property of their respective creators and are served by YouTube. We claim no ownership over this content. We display it as part of an indexing and discovery service in a manner consistent with how third parties access YouTube’s public data through its API and CDN.

By using the Service you also agree to be bound by the YouTube Terms of Service, and you acknowledge that Google’s use of any data accessible through the YouTube Data API is governed by the Google Privacy Policy.

If you are a creator and you would like your channel or specific thumbnails removed from the index, contact us at trebuhdev@gmail.com with the channel URL or video URLs concerned. We will action reasonable requests within 7 business days.

6. Our intellectual property

The Service’s design, code, automatic tagging logic, search interface, and the “ThumbnailUp” name are owned by us. You may not copy, modify, or create derivative works of the Service itself, except as required for personal, non-commercial use of the Service through a standard web browser.

7. Future features (analyzer, AI generation)

Some features described elsewhere on the site (for example, a thumbnail analyzer or AI thumbnail generator) are not part of the current Service and may be released later, possibly as paid features subject to additional terms. Where AI thumbnail generation is offered:

  • You retain rights to the prompts you submit and to the images generated from them, subject to the terms of the underlying generative AI provider.
  • You may not use the generator to imitate, impersonate, or otherwise create content designed to be confused with the work of a specific named creator, brand, or public figure.
  • You are responsible for ensuring the prompts you submit and the images you publish do not infringe any third party’s rights.
  • Reference images supplied to the generator must be images you own or are licensed to use. Indexed YouTube thumbnails may not be used as reference inputs.

8. No warranties

The Service is provided “as is” and “as available”. We do not warrant that view counts, tags, outlier scores, or any other data shown on the Service are accurate, current, or complete. Data is refreshed periodically and may lag behind YouTube. The Service may be modified, paused, or discontinued at any time.

9. Limitation of liability

To the maximum extent permitted by Polish and EU law, we are not liable for any indirect, incidental, consequential, or special damages, or for loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the amount you have paid us in the 12 months preceding the claim — for the current free Service, this amount is zero.

Nothing in this section limits liability that cannot be excluded under applicable law (including liability for intentional misconduct or gross negligence under Polish law).

10. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be communicated through the Service. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland. Disputes arising from the Service that cannot be resolved informally shall be brought before the courts competent for the operator’s place of residence, except where mandatory consumer protection rules (including those under EU law) provide otherwise for users acting as consumers.
